1. Acceptance
This End-User License Agreement ("Agreement") is a legal agreement between you and WPC Solutions ("we", "us") for the Aperture Studio AI software, including all associated media and documentation ("Software"). By installing or using the Software, you agree to this Agreement. If you do not agree, do not install or use the Software.
When you obtain the Software from the Microsoft Store, your use is also subject to the Microsoft Standard Application License Terms and the Microsoft Store Terms of Sale. Where those terms and this Agreement conflict, the Microsoft terms control for matters of distribution, purchase, and refunds.
2. License grant
Subject to this Agreement and to any applicable tier or license limits, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on Windows devices for your own personal or business use.
Aperture Studio AI may be offered with a free tier and a paid ("Studio") tier, or as a one-time purchase. The specific features, limits, and activation mechanism of your license are described in the app and on the Store listing at the time of acquisition.
3. Restrictions
You may not, except to the extent applicable law or the app's source license (see Section 8) permits:
- sell, rent, lease, sublicense, or redistribute the packaged Software as your own product;
- remove or alter any proprietary notices;
- use the Software to build a competing product by copying its packaged assets or trademarks;
- attempt to circumvent tier or license limits.
4. Your content and files
The Software is a non-destructive organizer. It catalogs references to your existing photos and videos and does not claim any ownership of your files, catalogs, keywords, or other content. You are solely responsible for your files, for maintaining your own backups, and for having the rights to any media you organize with the Software. We do not access your content except as described in the Privacy Policy.
5. Optional third-party services
The Software offers optional integrations (for example, cloud AI keywording via Google Cloud Vision or Amazon Rekognition, and Google Photos import). If you enable them:
- you are responsible for your own accounts, API keys, and any fees those providers charge;
- your use of those services is governed by their terms and privacy policies;
- we are not responsible for third-party services' availability, results, or charges.
6. Updates
The Software may be updated through the Microsoft Store. Updates may add, change, or remove features. This Agreement governs any updates unless an update is accompanied by its own terms.
7. Media tools and open-source components
The Software downloads and uses third-party open-source tools at runtime (including ExifTool and FFmpeg) and includes other open-source components (including the ONNX Runtime). These are provided under their own licenses, and nothing in this Agreement limits your rights under those licenses. Attribution and license texts for bundled components are available from the publisher on request.
8. Source license (open source)
The Aperture Studio AI source code is published under the MIT License
(see LICENSE in the project repository). The MIT License grants broad rights over the source
code. This EULA governs your use of the packaged application distributed through the Microsoft
Store and the associated services/branding.
9. Disclaimer of warranty
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU USE THE SOFTWARE AT YOUR OWN RISK. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT IT WILL PROTECT AGAINST DATA LOSS — MAINTAIN YOUR OWN BACKUPS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SOFTWARE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE, IF ANY. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Termination
This Agreement applies until terminated. It terminates automatically if you breach it. On termination you must stop using and uninstall the Software. Sections 4, 9, 10, and 12 survive termination.
12. Governing law
This Agreement is governed by the laws of Brazil. Any disputes shall be subject to the courts of the publisher's domicile, without prejudice to mandatory consumer protection rules applicable in your country of residence.
13. Changes to this Agreement
We may update this Agreement. Material changes take effect for new versions of the Software. Your continued use after an update constitutes acceptance of the revised Agreement.
